India Rejects an AI Inventor Claim in a Patent Case

India’s Patent Office refused a patent application in mid-April 2026, ruling that an artificial intelligence system cannot be recognized as an inventor under the Patents Act, 1970.[2]

The decision is notable for international patent policy because it reinforces a human-inventor standard at a time when countries are still divided over whether AI-generated inventions can qualify for patent protection.[2]

It also adds to the global debate on how patent law should treat software-driven technical solutions, especially as governments and patent offices revisit the boundaries of inventorship and patentable subject matter.[2]
