Germany’s Court Opens the Door to AI-Created Industrial Designs

Germany’s Federal Court of Justice has allowed an industrial design for a lunchbox created with artificial intelligence to be patented, a decision that could influence how major economies treat machine-generated inventions and designs.[2]

The ruling is significant because it touches one of the most contested questions in global patent policy: whether AI-assisted or AI-generated outputs can qualify for legal protection as inventions or designs. The decision may affect future filings in Europe and beyond, especially as companies push for clearer rules on patentability in the AI era.[2]

Patent activity is also rising more broadly: the World Intellectual Property Organization reported that international patent applications under the PCT system increased for a second straight year in 2025, reaching 275,900 filings.[4]
