Russia Doubles the Patent Filing Grace Period for Disclosed Inventions
Russia’s State Duma approved a law that extends the deadline for filing a patent application after an invention has been publicly disclosed from 6 months to 12 months, including disclosures made at international exhibitions.[2]
The change amends the Russian Civil Code and is meant to give inventors more time to preserve patent eligibility after presentations, publications, or other public disclosures.[2]
According to legal commentary published after the vote, the longer grace period is designed to reduce the risk that early disclosure will destroy novelty, a key requirement for patent protection.[1]
